Water Cleanup Company Terms of Service

Important terms, conditions, independent contractor disclosures, and operational disclaimers governing the use of Water Cleanup Company and our nationwide emergency restoration dispatch network.

Last Updated: January 1, 2025

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you (whether individually or representing a residential household or commercial entity, "you" or "User") and Water Cleanup Company ("Company," "we," "us," or "our"), governing your access to and use of the website https://watercleanupcompany.com and our telephone dispatch services accessible via (855) 563-0161.

By browsing this website, requesting emergency assistance, placing a telephone call to our dispatch lines, or submitting an inquiry for water damage cleanup, you expressly acknowledge that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using our website and dispatch services and must discontinue use immediately.

2. Referral & Dispatch Service Disclosure (Not a Direct Contractor)

PLEASE READ CAREFULLY: Water Cleanup Company operates strictly as a digital marketing, lead referral, and dispatch coordination platform.

  • Water Cleanup Company is not a direct water damage remediation contractor, environmental consulting firm, insurance adjuster, or public utility provider.
  • We do not directly operate water extraction equipment, perform mold remediation, or execute physical construction repairs on your premises.
  • Our primary function is connecting property owners experiencing water emergencies with independent, third-party water damage cleanup and restoration contractors who operate within their local geographic territory.
  • All on-site moisture assessments, thermal imaging, industrial water extraction, dehumidifier placement, antimicrobial sanitization, and structural repairs are performed exclusively by independent third-party restoration contractors.

3. Independent Contractor Relationship

The restoration professionals and emergency service companies connected through Water Cleanup Company are independent contractors and are not employees, agents, joint venturers, or legal representatives of the Company.

  • Any price estimate, formal scope of work, emergency service contract, work authorization, or labor warranty is formed solely and directly between you and the executing independent restoration contractor.
  • Water Cleanup Company does not control, supervise, manage, or direct the physical methods, remediation techniques, safety protocols, or labor employed by independent contractors during water extraction and drying.
  • We do not guarantee or warrant the quality, timeliness, licensing status, insurance coverage, or standard compliance of any third-party contractor's workmanship. Property owners are encouraged to independently verify the credentials, licensing, and liability insurance of any contractor performing work on their premises.

4. Emergency Assessments & Preliminary Project Estimates

Any damage severity classifications, equipment count discussions, or preliminary pricing estimates provided over the telephone or via web forms represent non-binding general approximations based on customer-provided information.

  • Accurate water mitigation scopes require on-site moisture detection using calibrated penetrative pin meters, non-invasive impedance sensors, and thermal imaging cameras to map the true boundary of moisture migration.
  • Water damage categories (Category 1 Clean Water, Category 2 Gray Water, Category 3 Black Water) and drying classes (Class 1 through Class 4) must be confirmed in person by the responding restoration specialist in accordance with IICRC S500 standards.
  • Actual project costs will vary depending on water contamination level, affected square footage, saturated drywall or subflooring removal, containment setup, and drying equipment run duration.

5. Property Access, Utility Safety & Site Hazards

When scheduling emergency mitigation, property owners agree to provide safe, unobstructed access to affected rooms, basements, crawlspaces, and primary utility shut-off valves.

  • Electrical Hazard Precautions: Standing water contacting electrical outlets, appliances, or main service panels creates severe electrocution hazards. Occupants should avoid walking through flooded areas until power has been safely isolated at the main breaker panel by a qualified professional.
  • Main Water Shutoff: In the event of a burst pipe, frozen line, or plumbing failure, property owners are advised to locate and close the main incoming water supply valve immediately to halt active water flow.
  • Biohazard Awareness: For sewage backups, drain overflows, or rising exterior floodwaters (Category 3 water), occupants must avoid direct contact with contaminated water and allow certified specialists wearing appropriate personal protective equipment (PPE) to conduct containment and antimicrobial treatment.

6. Insurance Claims & Third-Party Adjusters

While responding independent restoration contractors commonly document moisture levels, take before-and-after photographic evidence, and supply standard itemized mitigation billing (such as Xactimate estimates) to support insurance claims, Water Cleanup Company does not guarantee insurance claim approval, coverage determinations, or deductible reimbursements. All decisions regarding insurance coverage are governed solely by your individual insurance policy and claims adjuster.

7. Equipment Operation & Drying Requirements

During the structural drying process, commercial high-volume air movers and LGR dehumidifiers must remain powered and running continuously (typically 3 to 5 days) to maintain the psychrometric conditions required to extract bound moisture from wood framing, concrete, and drywall. Prematurely disconnecting drying equipment may result in structural rot, warped framing, and microbial growth. Water Cleanup Company bears no responsibility for secondary damage resulting from client deactivation of drying equipment.

8. Telephone Communications & Call Recording Consent

By placing a telephone call to (855) 563-0161 or providing your phone number on https://watercleanupcompany.com, you acknowledge and consent that calls may be monitored and recorded for quality assurance, training, and dispatch accuracy. You agree to receive telephone calls and text messages from our dispatch center and affiliated restoration contractors regarding your emergency water damage inquiry.

11. Indemnification

You agree to indemnify, defend, and hold harmless Water Cleanup Company, its officers, directors, members, agents, and licensors from and against any claims, losses, liabilities, expenses, damages, and costs (including reasonable attorneys' fees) resulting from or arising out of your violation of these Terms, your interaction with third-party contractors, or property conditions on your premises.

Any dispute, claim, or controversy arising out of or relating to these Terms or our dispatch services shall be resolved through final and binding arbitration administered by the American Arbitration Association (AAA), rather than in court, and you agree to waive any right to participate in a class-action lawsuit or class-wide arbitration.

14. Severability & Entire Agreement

If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. These Terms constitute the entire legal agreement between you and Water Cleanup Company regarding the use of this website and dispatch services.
